New Thailand Land Allocation Act 2026: Enhanced Buyer Protection
The Deputy Government Spokesperson has announced that the revised Land Allocation Act (No. 3) B.E. 2568 will officially come into force on March 1, B.E. 2569 (March 1, 2026).
The amendments are designed to strengthen protection for buyers in housing projects, clarify supervision measures for developers, and align regulations with constitutional provisions regarding consumer rights.
Key Highlights of the New Law:
- Stricter Infrastructure Requirements.
Utilities such as roads, parks, and playgrounds are legally recognized as servitudes for the benefit of buyers. Developers must maintain them properly and are now required to provide bank guarantees (or guarantees from financial institutions) for infrastructure maintenance to protect buyer rights.
- Clearer Conditions for Developer Release.
A developer is only released from maintenance duties if buyers establish a Juristic Person to take over the assets, or if the assets are dedicated to the public. In such cases, the maintenance guarantees must be transferred to the Juristic Person or local authority.
- Buyer Self-Defense Mechanisms.
If a developer fails to perform their duties, buyers holding at least half (50%) of the sold plots have the right to file a request to establish a Juristic Person to manage the common property themselves.
- Revised Common Fee Rules.
The law allows for variable common fee rates based on land usage type or plot size, in accordance with regulations set by the Central Land Allocation Committee.
- Tougher Penalties.
Developers who violate committee orders face fines ranging from 50,000 to 100,000 THB, plus daily fines until the violation is corrected.
The government spokesperson noted that these amendments will help clarify responsibilities, reduce disputes in housing projects, and ensure fair legal protection for citizens.
"The government aims to elevate land allocation standards, making the process transparent, fair, and ensuring tangible protection of citizens' rights," she emphasized.
